Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Chaker Living GmbH, Mittagsweg 43, 26133 Oldenburg (hereinafter "Chaker Living"), and customers for the brokerage and provision of accommodations. Deviating conditions of the customer apply only if Chaker Living has expressly agreed to them in writing.

2. Subject Matter of the Contract

Chaker Living offers customers the opportunity to request accommodations (e.g., holiday apartments, worker rooms). Based on this request, Chaker Living selects a suitable accommodation from its own portfolio or from carefully chosen partners. The accommodation provision contract is concluded exclusively between the customer and Chaker Living. Chaker Living remains the sole contractual partner of the customer.

3. Request and Conclusion of Contract

By submitting the request via the contact form, email, WhatsApp, or phone, the customer makes a binding offer to conclude a contract. A contract is only concluded with written confirmation by Chaker Living. The booking confirmation contains the binding service and payment conditions.

4. Services

The scope of services is determined by the booking confirmation. Chaker Living is entitled to provide the service also through accommodations from partners. The customer has no right to be accommodated exclusively in properties from Chaker Living’s own inventory. Minor deviations in the equipment and location of the accommodations are reserved, provided they are of equal value.

5. Prices and Payment

All prices are in euros and include statutory VAT. Payment is due after invoicing and – unless otherwise agreed – within 7 days. For short-term bookings, Chaker Living may require advance payment. Additional costs (e.g., electricity, water, heating) are included in the agreed price unless expressly stated otherwise in the booking confirmation.

6. Cancellation by the Customer

The customer may withdraw from the contract at any time. The receipt of the cancellation notice by Chaker Living is decisive. The following cancellation conditions apply: up to 14 days before arrival: free of charge; 13 to 7 days before arrival: 50% of the total price; from 6 days before arrival or in case of no-show: 100% of the total price. The customer has the right to prove that a lesser loss has occurred. Chaker Living recommends taking out travel cancellation insurance.

7. Duties of the Customer

The customer undertakes to treat the accommodation with care and to report any damages immediately. The accommodation may only be used by the agreed number of persons. Pets are only allowed with prior agreement. Subletting or transferring the accommodation is not permitted. The customer is liable for all damages caused by them or their fellow travelers.

8. Liability

Chaker Living is fully liable for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty. For other damages, Chaker Living is only liable in cases of gross negligence or intent. Chaker Living does not guarantee the proper performance of services provided by third parties (partner accommodations). The customer is liable for all damages caused by them or their fellow travelers.

9. Data Protection

Chaker Living processes the customer's personal data exclusively in accordance with the statutory provisions of the GDPR. Details can be found in the privacy policy on the website.

10. Final Provisions

German law applies. The place of jurisdiction is Oldenburg, provided the customer is a merchant, a legal entity under public law, or a special fund under public law. Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
